CGT Tax loophole?

I think I found a loophole in the Form 12 for PAYE workers. I think it means that if you had a Capital Gains Loss in 2008 then you don’t have to pay CGT in 2009:

Page 15 of the Form 12 - Tax Return for the year 2009 states:
*If you have an overall Capital Gains Tax loss in 2008 there is no need to complete the sections below.
*

However, this is a typo - it obviously should read “If you have an overall Capital Gains Tax loss in 2009.

You can see from the 2008 Form 12 that they have just copied it over without changing the date from 2008 to 2009.

Anyone qualified care to guess if this would stand up as a loophole?

I’m qualified to guess no.

A tax expert however, will give you a 4 page disclaimer, say maybe and then suggest that the Revenue be asked for an opinion.
