Question - considering buying a home with sitting tenants.


Advice : House on sale, it has tenants. If I buy and wish to move into the property, do the leases survive the sale ( assume a normal,recent tenancy ). If it does survive, can I give them notice ?



Ask for vacant possession. Seller’s problem.

Generally speaking leases are legally binding regardless of sale unless there’s a specific clause in the lease concerning the sale of the property. If the tenants are out of lease and in part 4 tenancy, and you wish to use the property yourself, then it’s simply a month or 2 month notice depending on how long they’ve held tenancy on the property.
